PROCESSING COLLECTION BY LPL

On receipt of instruction a file will be opened and written and verbal contact by an experienced LPL account manager  will be made. They will advise the owner why we have been instructed and what we will do pursuant to recovery of the debt. Payment in full will be demanded by our account manager, who may also entertain payment plans provided they are acceptable by the instructing Administrator or Community President.

Files are managed and monitored on a daily basis and are followed through regularly until such time that the debt is recovered or we give reasons why the action has been concluded.

Regular reports are sent on the progress achieved together with proceeds of all recoveries being transferred to the Administrator or Community President by inter bank transfer in Euros or Sterling as soon as the recovered funds have been cleared by our bankers. In some circumstances payments are made from the owner direct to the Administrator or Community President, in which case we rely upon early notification so our records can be updated.

FEES:

Unless by previous arrangement LPL current charges are from 12.5% on all debts recovered in UK and from 16% in Ireland and all other countries. Our service is provided on a "No Recovery - No Fee" basis so you only pay a fee if we successfully collect the debt.

If there is a debt in excess of 2 years, fees may increase to 15%-20%. Fees do not include any/if applicable VAT nor do they include legal action. No legal fees are incurred unless we receive specific written instruction and authority from the Administrator or Community President to instruct Lawyers and then only after due consideration of cost estimates.

All fees are subject to our terms and conditions which are available on request.

Community's are requested to supply LPL with full Bank details including IBAN number and full bank postal address so that funds, less LPL fees, can be transferred quickly.

LITIGATION

Lawyers acting for LPL have researched the viability of commencing action against Spanish owners domiciled in the UK or elsewhere outside of Spain. Under EEC rules owners can be sued in the country where they are domiciled for a debt incurred in another EEC member country.

In 90% of cases passed to our lawyers and proceedings served, there has been payment with costs or an acceptable payment program set up. The Spanish Judiciary system can be drawn out and can take a very long time for a case to be settled. The UK & Ireland legal systems are much quicker and the enforcement procedures are speedier and more efficient.

ARTICLES OF ASSOCIATION OF COMMUNITIES

OR "REGIMEN INTERNA"

The Committee of owners will be summoned to an annual AGM, or any subsequent EGM, or additional meetings throughout the year. The meetings will be presided over by the President and attended by the Administrator.

Any changes in the constitution of the Community must be approved at the meeting and written into the rules or articles .

It is at one of these meetings that any changes or amendments to the collection of Community Charges must be sanctioned. We believe this will also include details of the of the appointment of third party collection agencies. Full details of the recommendations are available from LPL as to what amendments should be sanctioned by the Committee.

In Summary

LPL has shown a consistent recovery record by working on the premise that non Spanish nationals domiciled generally outside of Spain and particularly in the UK and Ireland can be successfully chased for overdue accounts incurred in Spain. By way of general collection procedures and thereafter commencing legal action outside of Spain, if necessary.

PROCEDIMIENTO

Una vez recibida la solicitud, se creará el expediente y uno de nuestros experimentados empleados tomara un primer contacto con el deudor verbalmente y por escrito, explicando precisamente el motivo de recibir esta comunicación y que pasos se va a tomar para recuperar la deuda. El encargado del caso le pedirá al deudor pagar la deuda en su totalidad, no obstante y dependiendo de cada caso se considerara un acuerdo de pago que la comunidad tendría que aceptar.

Todos los expedientes se actualizan diariamente durante todo el proceso de recuperación o bien se hace saber al cliente las causas por las cuales el caso se da por concluido.

El cliente recibe los informes acerca del progreso de cada caso regularmente. En cuanto recuperado y recibido el dinero por nuestros banqueros, se enviara una transferencia al cliente a través de inter bank en Euro o en Libra.

HONORARIOS

Nuestros honorarios se calculan a base de un 12.5% del dinero recuperado. Dichos honorarios se añaden a la deuda y el deudor debe pagarlo. En el caso de que el deudor pague exactamente lo que debe a la comunidad y se niegue a pagar lo que corresponde a nuestros honorarios, la comunidad se tiene que hacer responsable de pagar un 10% de la cantidad recuperada. En otras palabras LPL cobra un 10% de cada cantidad recuperada. Nuestro servicio funciona de modo de que si no recuperamos nada no cobramos nada.

La comunidad no incurrirá en ningunos gastos legales a no ser que nos indique por escrito comenzar el proceso judicial en el país de origen del deudor.

Todas nuestras tarifas están sujetas a los Términos y Condiciones de nuestra empresa y están a su disposición.

El cliente debe facilitar los datos de la cuenta bancaria de la comunidad donde quiere recibir el dinero recuperado.

LITIGACIÓN

Entendemos que algunas de las deudas traspasadas a LPL estarán sujetas a procedimientos legales en España. Esto no afecta al derecho del cliente de tomar acciones legales en el Reino Unido o en Irlanda. Si una sentencia ha sido obtenida en España, puede ser, bajo la legislación de CEE, ejecutada en el Reino Unido o en Irlanda.

Los abogados de LPL han investigado la viabilidad de iniciar nuevas acciones legales contra los propietarios con el domicilio en el Reino Unido o en otro lugar. Según las normas de la CEE un deudor puede ser procesado en el país de su domicilio por una deuda contraída en otro país miembro de la CEE. Hay que tener ciertos criterios en cuenta. Toda la información al respecto puede ser proporcionada por nuestro departamento legal.

En todos los casos que se han tramitado a nuestros abogados hasta el día de hoy para comenzar los procedimientos legales, casi todos los deudores han pagado o al menos han entrado en un acuerdo de pago previamente aceptado por la comunidad. Entendemos que el sistema judicial español es muy lento y podría tardar mucho tiempo para que un caso sea resuelto. En el Reino Unido e Irlanda, los sistemas jurídicos son mucho más rápidos y los procedimientos de ejecución de sentencias más rápidas y más eficientes.

ARTICULOS DE ASOCIACION DE COMUNIDADES O "REGIMEN INTERNA"

La comunidad de propietarios estará sometida a la Junta General Ordinaria, una Junta General Extraordinaria o cualquier junta adicional en el curso del año. Las juntas estarán presididas por el Presidente y atendidas por el Administrador.

Cualquier cambio en la Constitución de la Comunidad debe estar aprobado en la Junta e inscrita en los Estatutos de la Comunidad.

En una de dichas Juntas se aprobara cualquier cambio o modificación con respecto a las cuotas de comunidad.

LPL facilitara toda la información acerca de las recomendaciones en cuanto a que tipo de modificaciones deberían ser aprobadas por el Comité.
